Health Services Criminal Cases Analysis of Saraburi Province - การวิเคราะห์ผลการดำเนินคดีด้านบริการสุขภาพ ของจังหวัดสระบุรี
Abstract
The objective of this study was to analyze the legal management and outcomes of 2 cases performing illegal health services in Saraburi Province in 2013 in order to monitor the progress of legal actions and to use as guideline for future management. The 2 cases were considered illegal based on the Medical Facility Act B.E. 2541, the Medical Profession Act B.E.2525, the Dental Profession Act B.E.2537 and the Medical Technology Profession Act B.E.2547. It was conducted as a retrospective documentary study;
and the analysis was based on the details of the individual cases, the impacts of the illegal acts, the management steps, and the final outcomes. It was found that both cases began with complaints of people who observed that the medical services might not follow medical facility standards; and were likely to affect the health of services’ recievers. The Consumer Protection and Public Health Pharmacy Section had worked with concerned agencies investigating the situations and, when the illegal acts were confirmed,
proceeded with arresting and taking the culprits to the prosecutors. Both cases were finally sentensed for punishment by the court. Public education through mass media was conducted in both cases to raise social awareness. The legal management of the 2 cases was successful because of the close collaboration among responsible agencies in exchanging information and building mutual understanding on the process; and the process could be a guideline for similar incidents in the future. Another learning point was that there were variations of the details which required distinctive investigation and careful approaches that were suitable for each individual cases.
